INTRODUCTION
This page (together with the documents referred to on it) tells you the terms of use on which you may make use of www.houseofpilots.com (hereafter “SHOP“), whether as a guest or a registered user. Please read these terms of use carefully before you start to use the SHOP. By using our SHOP, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using our SHOP.
TERMS UPDATES
We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on your next order. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our Site. These Terms of Use are posted on 01 May 2020 and become effective on 02 May 2020.

YOUR DETAILS
Any information uploaded by you or given to us through this SHOP will be processed by us in accordance with our privacy policy (link). By using our SHOP, you consent to such processing and you warrant that all data provided by you is accurate.
ACCESSING OUR SHOP
Access to our SHOP is permitted on a temporary basis and we reserve the right to withdraw or amend the service we provide on our SHOP without prior notice. We will not be held liable if, for any reason, our SHOP is unavailable at any time or for any period. From time to time, we may restrict access to some parts of our SHOP, or our entire SHOP, to all users.
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.
You are responsible for making all arrangements necessary for you to have access to our SHOP. You are also responsible for ensuring that all persons who access our SHOP through your internet connection are aware of these terms and that they comply with them.
AVAILABILITY OF PRODUCTS
All product orders are subject to availability. Along this line, if there are difficulties regarding the supply of products or there are no more items left in stock, we reserve the right to provide you with information on substitute products of the same or higher quality and value that you may order. If you do not wish to order the substitute products, we will reimburse any amount that you may have paid.
We aim to update our SHOP regularly and may change the content at any time. If the need arises, we may suspend access to our SHOP, or close it indefinitely. Any of the material on our SHOP may be out of date at any given time, and we are under no obligation to update such material.
YOUR ORDER
Your order for goods is accepted and a contract is formed between Flyinsite VOF and you when we dispatch the goods you have ordered and not before. A contract is not formed at the point in time that payment has been taken from you by Flyinsite VOF, nor at the point in time that you receive an email from us acknowledging receipt of your order. Until the goods are dispatched the order may not be accepted by us, or may be cancelled by you. Exceptions apply to orders for personalised items and goods made to your order which cannot be cancelled by you once you have received an email confirmation that your order has been received, as such items and goods may already be in production as a result of your order.
For security reasons we may restrict the volumes of certain items to be sold in any one transaction. Following formation of the contract, we shall continue to own any goods ordered until it has received payment in full from you, even though the goods may have already been delivered to you.
DELIVERY
Delivery within Belgium and the Netherlands is usually within 1-2 working day(s) from receipt of the order. Orders confirmed prior to 22:00 local time (10pm) are dispatched that same day. If your order is received after 22:00 local time (10pm), we dispatch the following working day. If for any reason we cannot process your order within this time period we will contact you immediately to inform you of the new delivery date. If the new delivery date is inconvenient to you, you may cancel your order.
Should part of your order be out of stock, we will hold the entire order. At the same time, we will contact you by e-mail to advise you of the stock shortage. The remaining item(s) can then be placed on back order, although this will incur an additional shipping charge. Alternatively, the missing items can be removed from the order and then re-ordered on another occasion. When your order contains a product which is clearly marked as a ‘pre-order’, the same rule applies.
When ordering goods from outside the EU, be advised that you are responsible for the import duties/taxes in your country. We advise you to check with your local authorities what these will be prior to placing your order.
INABILITY TO DELIVER
Depending on the transporter used, your parcel will either be left at a specified secure location or it will be kept for 1-2 weeks at your local postal office or pick-up point so you can pick it up. In the latter case, you should receive an e-mail or a note in your mailbox stating that a delivery attempt has been made.
As you will always receive the tracking information by e-mail, you should be able to trace your parcel’s location at all times. You can also choose to have your order sent to a pick-up point or a parcel machine.
Although it doesn’t happen frequently, it is possible that tracking information indicates that your parcel has been delivered while in fact you did not receive it in person. We would like to advise you to first have a good look around, as some transporters might leave the package at a hidden location (like your garden, terrace, entrance hall or even inside a waste container). Please also check with your neighbours, as they might have kept the package awaiting your return.
If the package is still nowhere to be found, please contact us immediately so we can take appropriate action.
PRICING AND PAYMENT
The price of the products will be as stipulated at all times on our Site, except in the case of an obvious error. Although we make every effort to ensure that the prices featured on the web page are correct, errors may occur. If we discover an error in the price of any of the products that you have ordered, we will inform you as soon as possible and give you the option of confirming your order at the correct price or cancelling it. If we are unable to contact you, the order will be considered cancelled and all amounts paid will be reimbursed to you in full.
We are not obliged to provide you with any product at the incorrect lower price (even when we have sent the Shipment Confirmation) if the error in the price is obvious and unmistakable and could have reasonably been recognised by you as an incorrect price.
The prices on the Site include VAT, but exclude delivery fees, which are added to the total price. Prices may change at any time. However, except as stipulated above, the changes shall not affect the orders for which we have sent an Order Confirmation.
Throughout the purchase process, before payment, you can modify the details of your order. Also, if you are a registered user, a record of all the orders placed by you is available in “My Account” area.
You may use, as payment method, cards like Visa, Mastercard, American Express, Bancontact, Bancontact QR code in addition to Paypal, iDEAL, P24 and SOFORT. Alternatively, you can pay all or part of the price of your order with a CrewLounge.Shop Gift Card or a credit voucher issued.
VAT
Customers from EU member states are charged Dutch VAT (Value Added Tax) at 9% or 21% (depending on the product type) unless you have a business registered for VAT and are able to provide proof of your country code and VAT number. Orders received from outside the EU will be automatically charged without VAT.

HAZARDOUS GOODS
Certain goods such as Life-rafts and some Aerospace Chemicals are classed as hazardous for export purposes. As a result, on receipt of an order with these types of items in it, we may have to contact you to discuss an additional charge to cover the cost of the Hazardous Packaging Requirements.
OUR LIABILITY
The material displayed on our SHOP is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we and third parties connected to us hereby expressly exclude:
- all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity; and
- any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our Site or in connection with the use, inability to use, or results of the use of our Site, any websites linked to it and any materials posted on it, including, without limitation any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
The above exclusions do not affect our liability for death or personal injury arising from our negligence, or our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.
INTELLECTUAL PROPERTY RIGHTS
You recognise and agree that all copyrights, registered trademarks and other intellectual property rights to the materials or contents provided as part of the SHOP belong to us at all times or to those who grant us license for their use. You may use said material only to the extent that we or the usage licensers authorise it expressly. This does not prevent you from using this SHOP to the extent necessary to copy the information on your order or Contact details.
VIRUSES, PIRACY AND OTHER COMPUTER ATTACKS
You must not make undue use of this SHOP by intentionally introducing a virus, Trojan horse, worm, logic bombs or any other software or technologically damaging or harmful material. You shall not attempt to make unauthorised access to this SHOP, the server on which the site is housed or any server, computer or database related to our SHOP.
You agree not to attack this SHOP through any attack of denial of service or an attack of distributed denial of service. Failure to comply with this clause shall be considered an infraction as defined under the applicable regulations. We will report any failure to comply with this regulation to the corresponding authorities, and we will co-operate with them to determine the identity of the attacker. Likewise, in the event of failure to comply with this clause, authorisation to use this SHOP shall be suspended immediately.
We shall not be held liable for any damage or harm resulting from a denial of service attack, virus or any other software or technologically damaging or harmful material that may affect your computer, IT equipment, data or materials as a result of using this SHOP or downloading content from the same or those to which this site redirects you

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. JURISDICTION AND APPLICABLE LAW
The use of our Site and the product purchase contracts through said Site shall be governed by Dutch legislation. Any controversy that arises or is related to the use of the Site or said contracts shall be subject to the jurisdiction of the Dutch courts.
